On November 6, 2015 at Noon in the Upstairs Conference Room of the Bar Association building, we will present Managing the Risks in Conducting Criminal Background Checks. Employers in Maryland and across the country are seeing increased litigation risk (including class action risk) for performing criminal background checks as part of the hiring process. The EEOC, Department of Labor and the plaintiffs’ class action bar are exposing employers’ widespread failure to comply with the strict requirements of the federal Fair Credit Reporting Act (“FCRA”) and state-level “Ban the Box” laws, among other regulations. Despite the increasing litigation over these issues, and multi-million dollar settlements nationwide, many employers still lack a full understanding of what is required for compliance. We will provide an overview of compliance points for performing criminal background checks, discuss the trends in litigation, and make suggestions on advising employers to best reduce their risk. We have arranged for attorneys from the law firm of Hunton and Williams to do the presentation.
