Alternative Dispute Resolution Section 

 

     The ADR section will meet on Thursday, April 9, 2015 at 5:30 pm in the large conference room at the Bar Association. The last roundtable meeting of the Section was so successful that by popular demand we will do it again. The topic will be,"Are mediation clauses enforceable--and what language is most effective?"   Everyone is asked to (1) review Miller v. Mathias, 428 MD 419, 52 A.3d 53 (2012) in which the Court of Appeals allowed the matter to go forward despite a clause which one side argued required mediation before litigation and (2) bring copies of clauses you include in contracts and settlement agreements by which you intend to require require mediation prior to litigation (be prepared for participants to dissect your terms). Finally, we will be accepting self nominations to chair the section next year.
